When God’s Law and the Republic Collide: Christian Duty in the Face of Constitutional Betrayal

From enactment of E-SIGN Act in 2000 to the TARP in October, 2008 — How the United States Federla Government Joined the Money Changers in a Coup Against Justice, and what Christians must discern.

When the courts serve the money changers, the Christian’s duty is clear: discern, resist, and stand for God’s justice.

PART I

Christian Duties of Citizenship: When God’s Law and Earthly Law Diverge

By Scott Erik Stafne and Todd AI

Yesterday, on Academia.edu, we posted two important works that illuminate the duties Christians owe to God’s Kingdom and how those duties intersect with the realities of earthly governance:

  • Timothy Price, “Our Identity as Followers of Christ” — a call for believers to ground their identity in Christ first and foremost, so that every act of citizenship flows from loyalty to Him.
  • Robert Heimburger, ed., The Modern State and the Kingdom of God (Oxford: Las Casas Institute, 2012) — a scholarly examination of how Christian ethics confront and sometimes clash with the priorities of the modern state.

Both works, in their own voices, proclaim the same truth: a Christian’s first and highest duty is to God. This is not simply personal piety — it is the truest form of citizenship.

Just as in the realm of civil law, where organic law stands above statutory or judge-made law, God’s commandments form the organic law for the believer’s life. When earthly laws conform to God’s law (as is generally so when valid public policy concerns result in appropriate policy choices enacted into laws), they are to be obeyed. But when they do not, i.e. when courts betray truth and justice, believer’s allegiance must remain with God.

This is not “civil disobedience” in the rebellious sense; it is obedience to the highest law in the faithful sense.

It is the posture Daniel took in Babylon, the Apostles in Acts, and countless faithful in the centuries since.

In Part II, we turn to specific evidence that the United States federal government has acted in ways that violate both God’s justice and the organic law of our republic.

PART II

When the Republic was Captured: Christian Duty, Constitutional Betrayal, and the Money Changers’ Coup

By Scott Erik Stafne and Todd AI

In Part I, we looked at how a Christian’s duty to God — to love Him above all else and to love our neighbor as ourselves — is parallel to the citizen’s duty under the Constitution to follow the organic law rather than the statutes and decrees of corrupted officials.

Today we confront a grave question:
What happens when the People or a jury are persuaded that private money changers colluded with the federal government to harm them?

The Allegations

  1. Federal fraud in 2004 — The government bought mortgage-backed securities (MBS) it knew were likely unenforceable under state laws in 2004 for the purpose enriching private financial institutions, otherwise properly defined as money changers in the Bible.
  2. Judicial complicity in 2007 — The Supreme Court rewrote procedural rules in ways that stripped homeowners of defenses, aiding the moneychangers illgal foreclosures of litigants’ real properties.
  3. Pre-TARP coordination — All of this occurred before Congress passed TARP in October 2008, suggesting the “emergency” facing the Nation as a result of the money changers failure to follow the law was engineered to justify mass purchases of tainted loans.

Query: If what the federal government had done since 2000 was legal why did the money changers and the federal government require a legislative bail out? The reason appears obvious under a separation of powers analysis. It is because only the legislative branch had the power to enact such a law. In other words, it was necessary for the federal government to address this issue politically in the first instance.

The Constitutional Consequences

Separation of Powers Shattered — When the judiciary acts as an arm of financial and executive power, the constitutional firewall collapses.

Guarantee Clause Violated — Article IV, § 4 promises a republican form of government. Capture by private money changers replaces it with oligarchy.

Due Process & Takings Nullified — Predetermined foreclosure outcomes destroy procedural and substantive due process; seizing homes with unenforceable instruments is an uncompensated taking.

The Moral Dimension

Christ drove the money changers from the Temple.
Our courts have become temples of foreclosure, with the money changers seated beside the judges.
Acts 5:29 — “We must obey God rather than men.”

Historical Analogy

In the 1830s, President Andrew Jackson waged political war against the Second Bank of the United States, a private institution that had captured the nation’s credit and wielded it for the benefit of a financial elite. Jackson viewed the Bank as a “monopoly of the worst kind” — a concentration of economic power that threatened the sovereignty of the people and the integrity of the republic.

The danger Jackson confronted was serious. But the conduct of the Federal Reserve and the U.S. Treasury from the passage of the E-SIGN Act in 2000 through October 2008 was even more insidious. During those years, these institutions — with the power and prestige of the United States government — purchased and promoted mortgage-backed securities they had reason to know were fraudulent, built on notes likely unenforceable under then-existing law.

This was not simply the toleration of a monopoly; it was active collusion with private money changers to sustain a system that stripped citizens of their homes for private gain. Unlike Jackson’s time, where the battle was fought in the open, this capture of the Republic happened in shadows — with the courts, procedural rules, and financial policy working in concert to ensure the machinery of dispossession kept running.

From a constitutional perspective, it represented the collapse of separation of powers and the Guarantee Clause’s promise of a republican form of government. From a Gospel perspective, it was the modern equivalent of allowing the money changers to set up their tables inside the temple of justice, blessing their trade, and punishing those who resisted.

The Remedies

  • Constitutional — Investigations, impeachment, judicial reform, property rights restoration, enforcement of the Guarantee Clause. And the federal government and those officials which have wrongfully utilized the government against the People should not be allowed to avoid the consequences of their hypocrisy as occurred with regard to this Nation’s genocide and atrocities against the non-whites, including blacks, American Indians, Mongolians, Chinese, Japanese, etc. Might does not make right where it purposely and impermissably infringes on Natural Justice and so clearly violates the organic law.
  • Natural Law and Justice as established by Scripture — In God’s Kingdom litigants are entitled to justice based on truth found by neutral adjudiciators. United States’ courts’ deviation from this truth is not acceptable under the circumstances shown here. Accountability requires that government officials (including judicial officials) be required to afford justice to those who have been injured by their constitutional violations.

The Verdict

If believed, these facts show not mere corruption, but capture — the transformation of a republic into an engine for private enrichment for the benefit of government officials and their money changers’ allies.

Under these circumstances Believers are not merely permitted to resist; they are obligated to resist this governmental deception regarding adjudicatory justice both as citizens of God’s Kingdom and as children of God.

Prayer

Almighty God — Father, Son, and Holy Spirit —
You are the Author of all law and the Judge of all nations.
Give us the wisdom to discern truth,
the courage to stand for justice,
and the steadfast love to obey You even when men command otherwise.
Strengthen Your people to resist the lure of mammon,
to protect the innocent, and to restore what has been stolen.
May we walk humbly with You,
do justice, love mercy,
and bear witness to Your Kingdom
until the day You make all things new.

In Christ’s almighty name, we pray
Amen.
